These Terms of Service ("Terms") govern your use of Cabin, a service operated by Cabin Agency Inc. ("Cabin", "we", "us"). By creating an account or using Cabin, you agree to these Terms. If you are using Cabin on behalf of a business, you represent that you are authorized to bind that business.
1. The service
Cabin helps small businesses get a website built and hosted, including an AI-generated first draft, design assets, and ongoing changes. Features may change over time. We may add, modify, or discontinue parts of the service.
2. Accounts
You sign in with a one-time link sent to your email. You are responsible for keeping access to your email account secure and for activity that happens under your account. Tell us promptly if you believe your account has been accessed without authorization.
3. Acceptable use
You agree not to use Cabin to:
- break the law or infringe anyone's rights (including intellectual property);
- upload malware, attempt to disrupt the service, or access it without authorization;
- publish content that is unlawful, deceptive, hateful, or harmful; or
- misrepresent your business or impersonate others.
4. Your content and ownership
You keep ownership of the content you provide - your business information, text, and any images, photos, logos, or other media you upload. Where we create assets for you - such as a generated website or a logo we design - those deliverables are yours once any associated fees are paid. To operate the service and to build, preview, host, and publish your site, you grant us a worldwide, non-exclusive, royalty-free license to store, host, reproduce, modify, adapt, and display that content, and to sublicense it to the hosting, storage, and content-delivery providers we use for those purposes. Cabin's own platform, software, templates, and design systems remain our property.
Rights in what you upload. You represent and warrant that, for every photo, image, logo, font, or other file you upload or ask us to publish, you either own it or hold all rights, licenses, and permissions needed to use it and to grant the license above - including, where applicable, rights to any third-party material and the consent of any identifiable people shown, plus any required model or property releases. Do not upload media you don't have the right to use - for example, images found online, stock photos used outside their license, or another business's photography, logos, or branding.
We may remove, or decline to publish, any content we reasonably believe infringes someone's rights or violates these Terms. You are responsible for ensuring your content is accurate (for example, business hours, prices, claims, and credentials shown on your site). Claims arising from the content you provide are covered by your indemnity in Section 9.
5. Fees and billing
Paid plans and add-on services (such as custom logo design) are billed as described at the time of purchase. Unless stated otherwise, fees are non-refundable. Taxes may apply. We may change pricing on a going-forward basis with notice.
6. Third-party services
Cabin relies on third-party providers (for example, payment processing, hosting and content delivery, email, and AI model providers). Your use of the service may be subject to those providers' terms, and we are not responsible for their services.
7. Disclaimers
The service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that AI-generated content will be accurate or suitable for your purposes - you are responsible for reviewing it before publishing.
8. Limitation of liability
To the fullest extent permitted by law, Cabin Agency Inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues. Our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim.
9. Indemnity
You agree to indemnify and hold harmless Cabin Agency Inc. from claims arising out of your content, your use of the service, or your breach of these Terms.
10. Termination
You may stop using Cabin at any time. We may suspend or terminate access if you breach these Terms or to protect the service. On termination, your right to use the service ends; provisions that by their nature should survive (ownership, disclaimers, limitation of liability) survive.
11. Changes to these Terms
We may update these Terms. If we make material changes, we will take reasonable steps to notify you. Continued use after changes take effect means you accept the updated Terms.
12. Governing law
These Terms are governed by the laws of the Province of Ontario, Canada, and the federal laws applicable there, without regard to conflict-of-laws rules. The courts located in Ontario have exclusive jurisdiction.
